We invite you to use our website and «Buy Easy» application hosted in the App Store and use «Buy Easy» services (hereinafter collectively called - «Buy Easy» or service). Note that our offer is valid only if you are familiar and agree with these Terms of service. This document describes in detail your and our rights in respect of the Service, so you should carefully review them.
«Buy Easy» - it is a tool to create, manage and share shopping lists. «Buy Easy» allows you to electronically create lists, fill list of goods, share them with you fellows and some more. «Buy Easy» can be used on iOS devices around the world.
1.1 These Terms of Service (hereinafter called Terms) constitute the agreement between you and us. Terms include provisions set forth in this document and other conditions, which may be provided by us and to be accepted by you at any point in time with respect to individual services. If you do not agree to these Terms of Service, it deprives you of the right to access and use «Buy Easy». By signing up to «Buy Easy», using it in any other way, you agree to the Terms of Service and agree to abide this agreement, which is binding.
1.2 We can agree with you the additional terms of use, which we will inform you in due time prior to use.
1.3 We preserve the right to offer additional services. These Terms of Use are aimed at ultimate users and business.
2.1 The purpose of this agreement is free used functions in «Buy Easy» applications, which can be obtained via mobile applications in their respective supermarkets. All data is stored only locally on user’s device the cloud, and can be obtained at any time using mobile applications. «Buy Easy» offers for different tasks:
2.1.1 Each application installed instance contains a variety of tools and features, as well as pre-installed sample lists.
2.1.2 You can use these ones, create additional lists, delete and modify any of lists in your application instance.
2.1.3 By editing and modifying your lists you get one general list and a result of your editing actions.
2.1.4 You can share these lists to others by email or via «Messenger» application.
2.1.5 «Buy Easy» is free to use.
2.2 We will not be held responsible for device’s operating system failure or incorrect behavior, internet access, network-related downtime and, in particular, downtime, which «Buy Easy» may not be available due to technical or other problems outside of our sphere of influence, for example, force major, the fault third parties.
3.1 You can use «Buy Easy» without registration.
3.2 «Buy Easy» is provided on a free basis Once you’ve downloaded the app you have access to its basic features.
3.3 Access to some additional features within the app is limited. Full access to them requires paid subscription.
3.4 Rules of the «Buy Easy»
3.4.1 When using «Buy Easy» you must comply with all applicable laws. In particular, you can not enter and / or distribute illegal data or data that violates copyright and any other rights of third parties. Such data include, but are not limited to: text, images, charts, or links. You are solely responsible for the content and data that you provide.
3.4.2 You may not upload any files depicting violent or pornographic, discriminatory, defamatory, racist, defamatory or otherwise illegal content or documents and / or make them available to the public. Pictures or photographs showing another people, can only be downloaded to «Buy Easy» only if you have the consent of this people.
3.4.3 The content and texts placed in «Buy Easy» may not be copied, distributed or made available to the public in any other way without the express consent of the copyright owner, unless it is permitted by law.
3.4.4 Acts of persecution, such as sending chain letters or communication of a sexual nature, or obscene are not allowed.
3.4.5 You can not attack the operational capacity of «Buy Easy» by any means, such as sending mass emails (spam); carrying out hacking attempts or brute force attacks; using or sending spyware, viruses.
3.4.6 In case of violation of these rules, we will have the right to issue a warning, temporarily block usage of «Buy Easy» or, if necessary, to fully exclude you from using it. We reserve the right to remove illegal content immediately.
3.4.7 Data Backup. You will take the necessary measures in accordance with its own risk assessment to regularly back up data and content that you have entered is loaded and stored on «Buy Easy», as well as create their own backups to ensure data recovery and the content in case of data loss.
3.4.8 We are not capable of identification of users. Therefore, we can not guarantee the correct identification of any user.
4.1 We accept no liability for text content, images, data and / or information downloaded by you or other users of «Buy Easy». In addition, we do not assume responsibility for the design and / or the content of external websites referenced «Buy Easy».
4.2 If you notice or suspect any illegal or non-contractual use of «Buy Easy», you can inform us at any time at this email address: buyeasyapp@gmail.com
5.1 Agreement on the use «Buy Easy» application is applicable for all the period this application is available in the AppStore and additionally 5 years after it will be removed from it.
5.2 You can terminate the contract at any time by selecting the option "Remove Application".
We reserve the right, at our sole discretion, to make changes or modifications to this Agreement at any time and for any reason. We will keep you informed about any changes by updating this Agreement and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review this Agreement to stay informed of updates. You will be subject to, and will be deemed to be aware of and to have accepted, the changes in any revised Agreement by your continued use of the App after the date such revised Agreement is posted.
«Buy Easy» service is provided "as it is" to the extent permitted by law.
YOU UNDERSTAND AND AGREE THAT:
(A) YOU USE THE SERVICE AND ACQUIRE, AND USE ANY PRODUCTS OR SERVICES IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF QUALITY AND AS AVAILABLE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, «Buy Easy» EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
(B) «Buy Easy» DOES NOT WARRANT THAT
(I) THIS SERVICE WILL MEET YOUR REQUIREMENTS;
(II) THE SERVICE WILL BE UNINTERRUPTED OPERATION, TIMELY, SECURE OR ERROR-FREE; OR THAT
(III) ALL ERRORS IN THE SOFTWARE OR SERVICE WILL BE CORRECTED.
(C) DOWNLOADING OF ANY MATERIAL OR RECEIVING HIS WAY THROUGH THIS SERVICE IS DONE AT YOUR SOLE DISCRETION AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR THE USE OF ANY SUCH MATERIAL.
(D) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM «Buy Easy» OR THROUGH THIS SERVICE SHALL CREATE ANY WARRANTY, EXCEPT AS EXPRESSLY STATED IN THE TERMS OF SERVICE.
YOU UNDERSTAND AND AGREE THAT «Buy Easy», ITS SUBSIDIARIES, AFFILIATES, LICENSORS, AND OUR AND THEIR OFFICERS, EMPLOYEES, AGENTS AND ASSIGNS SHALL NOT BE LIABLE TO YOU ANY LIABILITY FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL DAMAGES AND DAMAGES, SPECIAL BUSINESS OR EXEMPLARY PUNISHMENT, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF GOODWILL, USE, DATA OR INSURANCE COVERAGE OR OTHER INTANGIBLE LOSSES (EVEN IF «Buy Easy» HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
(I) THE USE OR INABILITY TO USE THE SERVICE OR USE OF THE CODE OF POINTS OR IMPROVEMENTS «Buy Easy»;
(II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES, THE NEED FOR THAT RESULT FROM PURCHASE OR RECEIPT OF GOODS, PRODUCTS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS BY OR UNDER THE SERVICE;
(III) UNAUTHORIZED ACCESS TO, DAMAGE TO, ALTERATION OR LOSS OF YOUR CONTENT, DATA OR TRANSMITTED BY YOU MATERIALS,
(IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY, IMPLEMENTATION WITHIN THE SERVICE OR WITH HIS HELP, OR ANY THIRD PARTY, PROVIDE ANY SERVICES IN CONNECTION WITH PERFORMANCE OF THE SERVICE OR «Buy Easy» MARKET;
(V) ACTS OR OMISSIONS «Buy Easy» BASED ON YOUR CREDENTIALS, AS AMENDED, AND NOTIFICATIONS RECEIVED UNDER YOUR ACCOUNT;
(VI) YOUR FAILURE TO ENSURE THE CONFIDENTIALITY OF THE PASSWORD AND RIGHTS TO ACCESS YOUR ACCOUNT INFORMATION;
(VII) ACTS OR OMISSIONS OF THIRD PARTIES FROM THE USE OF THE SERVICE OR INTEGRATION WITH HIM;
(VIII) ANY ADVERTISING MATERIAL OR PURCHASE OR USE OF THE PRODUCTS OR SERVICES ADVERTISED OR ANY OTHER THIRD PARTY PRODUCTS OR SERVICES;
(IX) CLOSING YOUR ACCOUNT IN ACCORDANCE WITH THESE TERMS OF SERVICE;
(X) ANY OTHER CIRCUMSTANCES ASSOCIATED WITH THE SERVICE.
In our application we use following service providers:
9.1. This Agreement is valid and executed by the Parties on the basis of the law of Ukraine.
9.2. All disputes arising in connection with these Terms and Conditions are solved exclusively in the courts of Ukraine.
9.3. If individual provisions of these Terms of Service will be invalid and / or would be contrary to specific provisions of the legislation, it will not affect the validity of the remaining terms of service.
